Global Legislation for Wills & Estates

A Global or International/Multi-jurisdictional (GoIM) Will is a type of international Will that is governed by the Convention on the Uniform Law on the Form of an International Will. In Washington, D.C. on Oct. 26, 1973, an international treaty was adopted by UNIDROIT, the International Institute for the Unification of Private Law. GoIM Wills can be used to distribute, to beneficiaries, real estate and other assets located in any country globally, regardless of the law governing succession. This is possible because the Convention establishes a set of formal requirements that must be met for a single Will to be valid in all countries that have ratified it. To-date, only the following countries have introduced the requisite domestic legislation to recognize GoIM Wills: Australia, Bosnia-Herzegovina, Belgium, Canada, China, Croatia, Cyprus, Ecuador, France, Holy See, Italy, Iran, Laos, Libya, Niger, Portugal, Russian Federation, Sierra Leone, Slovenia, UK and USA .

A GoIM Will is a useful tool for people who live or own assets in multiple countries. This type of will guarantees that the will of the testator is respected in all places where he has interests. GoIM Wills must fulfil the following requirements:

  • Testator must be at least 18 years old and of sound mind.
  • The GoIM Will must be written in a language that the Testator understands.
  • The GoIM Will must be wet-signed by the Testator and at least 2 witnesses.
  • The GoIM Will must be dated.

In addition to the formal requirements established by the Convention, GoIM Wills must also comply with the legal requirements of the country in which the assets to be distributed are located and legalized by an embassy or consulate in the place where the GoIM was issued. The main advantage of GoIM wills is that the Will is respected in all countries that recognize them, where a testator has interests. GoIM Wills can also be successive to allow for modification or revocation and can cover many scenarios such as:

  • Testator lives in Canada and owns real estate in Italy and Portugal could use a GoIM Will to dispose of their assets in all 3 countries.
  • Testator works in Australia and owns real estate in their home country of Canada could use a GoIM Will to dispose of their property in Canada.
  • Testator has children in various countries could use a GoIM Will to appoint guardians for their children upon their death.

Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA)

RUFADAA is a law, developed by the Uniform Law Commission (ULC) in 2015, that provides the Executor of an Estate, or a lawyer, with access to an individual’s online accounts after death or should they become incapacitated. RUFADAA is the revision of UFADAA (Uniform Fiduciary Access to Digital Assets Act) which was passed in 2014 to provide Executors with access to a decedent’s digital assets, including unknown passwords and login information, allowing them to fully administer a decedent’s estate. RUFADAA extends the power traditionally given to the Executor of an Estate or a Trustee when managing someone’s tangible assets to also include their digital assets.

Today, 49 states have passed the Act or similar legislation, with legislation pending in Massachusetts as of November, 2022. The Uniform Law Conference of Canada adopted the Uniform Access Digital Assets by Fiduciaries Act (UADAFA) in August, 2016. UADAFA is mostly consistent with the RUFADAA provisions and so provides similar administration privileges. However, to-date only a few provinces have enacted UADAFA. Saskatchewan, Prince Edward Island and New Brunswick have enacted or are currently reviewing UADAFA provisions in provincial legislation

Our API allow Developers and Resellers to integrate any internal or external 3rd party applications with its software solutions. Developers can create complementary applications in virtually any language and business area and utilize data from our data store. Our Application Programming Interface is a RESTful API that provides secure, authenticated, access to users, data, audit information and more.

Since data security is of primary importance, the Web Service is secured via TLS using HTTPS. In addition, access will only be allowed from known, and approved, customer and partner IP addresses to further secure and prevent unauthorized access to the data store.

The Web Service utilizes Javascript Object Notation – Web Services Protocol (JSON-WSP) for its ease of readability for software developers as well as lay people. It includes a number of methods to allow access to:

  • Security information
  • User-defined configuration data
  • User Legacy data
  • Estate Administration data

The structure of the API documentation is in a request and response format. Data elements referenced in any request or response will be mapped to specific tables and fields in our data store to aid in 3rd party software development.
